Abstract

Fiqh al-Siyar and modern international law are the laws that deal with the conduct of States. The study deals with the issue of contradictions between Al-Siyar and modern international law. The aim of the research is to highlight the different challenges in its application of Islamic International Law in modern times. The study was conducted through document analysis as a tool in the descriptive and analytical research design. The challenges faced by the states were discussed and the areas of confrontations were identified through the research. The findings of the study showed that the modern application of Siyar can be done alongside the challenges faced. Implementation of Siyar can be executed by the OIC. The research concludes that modern international law can be implemented if the unilateral decisions and double standards of the powerful States are not practiced.
